OUR CONTRACT

By creating an account with SquidVault you agree to our terms of Service

You must be aged 18 or above to use our service. Any beneficiaries must also be at least 18 years old. By creating an account you accept that you are over 18 years of age and have mental capacity.

1.YOUR RESPONSIBILITIES AND OBLIGATION UNDER OUR TOS

1.1It is solely your responsibility to keep your user data up to date. We have no liability if you have not kept your user data up to date and accurate.

1.2You are responsible to keep copies of your user data for your personal records

1.3You Shall not attempt to reverse compile, disassemble, reverse engineer, or otherwise reduce to human-perceivable form all or any part of the Services or SquidVault

1.4You Shall not attempt to obtain, or assist third parties in obtaining, access to the Services or You Shall not , other than as provided under these terms; or

1.5You Shall not attempt to bypass or disable any security feature or mechanism within the Services.

1.6You agree that you shall not download , copy ,upload or share data unless you have the right to and any data uploaded shall not infringe on the Intellectual property rights of any third party.

1.7You Shall not use SquidVault to store, transmit, access or distribute any malware viruses or any illegal content. We have the right to disable any accounts that breach these rules

1.8You Shall not use SquidVault to store, transmit, access or distribute any harmful, threatening racially or ethnically offensive content or any content in a manner that is otherwise illegal or causes damage or injury to any person or property. We have the right to disable any accounts that breach these rules

1.9You Shall not attempt to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute (as applicable) all or any portion of the Services or SquidVault in any form or media or by any means; or

1.10You shall report any lost stolen devices that you have accessed SquidVault from to prevent unauthorized access

1.11You agree the maximum claim against SquidVault is limited to one hundred pounds

2.SERVICES

2.1.1By creating a SquidVault account you will be able to access a vault where you are able to do the following;

2.1.2Upload text documents

2.1.3Upload scanned documents

2.1.4Upload pictures

2.1.5Enter accounts information

2.2This data will be able to be shared with people of your choosing and will be accessible by beneficiaries appointed by you on confirmation of your death.

3.USE OF SERVICES

3.1You are responsible to keep the credentials to access SquidVault confidential and we are not liable for any loss of data from failure to keep details confidential

3.2You must only use your credentials to access SquidVault and must notify us immediately if there is any unauthorized or suspected unauthorized use of your account

4.SUPPLY OF SERVICES

4.1By completing the SquidVault Registration process the contract will come into effect. The service will be provided until the subscription expires.

4.2In the event of any maintenance, technical issues, and change in service we reserve the right to stop the services until they are resolved.

4.3In the event of any reason to suspend services we will notify you of any downtime and unless the issue needs to be urgently resolved. These suspensions should not exceed 24 hours. In the event that a service suspension exceeds 24 hours we will refund any time onto your subscription.

4.4At the end of a subscription period we will renew your subscription for an additional 12 months this will be taken as an annual payment, this can be stopped by canceling your subscription through SquidVault account settings page. You are responsible to keep payment information up to date which is located in the SquidVault account settings page. Subscription charges are non-cancellable and non-refundable.

4.5If a substantial delay in our service is disrupted by an event we were not responsible for we will notify you and attempt to resolve the service to the best of our ability. We are not liable for any delays caused by the loss of service.

5.VERIFICATION OF DEATH AND BENEFICIARY ACCESS

5.1On receiving the death certificate access will be provided to your SquidVault for the beneficiary, only the nominated beneficiary will be provided access. It is your responsibility to inform the nominated beneficiary about your SquidVault Account.

5.2No further payments will be taken and your subscription will be canceled on receiving the death certificate

6.DUTIES AND RIGHTS OF SERVICE

6.1We are not responsible for any failures due to transfer of data caused by communication failure or internet outages caused by any service providers or otherwise.

6.2Our service may encounter minor issues and we will work to resolve these issues as soon as we are aware of them. We do not guarantee a completely error-free experience

6.3Our services will be provided with care and quality in a professional manner.

6.4Any Intellectual property rights used by SquidVault are licenced or owned by us. By using our platform we do not acquire the rights to use any Intellectual property on SquidVault.

7.TERMINATION RIGHTS

7.1We reverse the right to end the contract if you do not have valid card payments at the time of renewal, and do not make payment after 7 days of the due date.

7.2We reserve the rights to end the contract if there is any violation of the service terms found on your account

7.3If payment is not received by the due date your account may be suspended. Payment after the date will be required to reactivate your account, if payment is not received 7 days after the due date we may terminate your account.

7.4If we believe any of the terms of service have been breached we reserve the right to terminate access to the account. If any breach has been found we may delete your account, suspend you completely from SquidVault or start legal action.

7.5In the event your account was suspended without a breach of the terms of service you will have the time of the termination added back onto your account subscription.

7.6We reserve to terminate services without notice, and as SquidVault sees fit without reason.

8.ISSUES WITH THE SERVICE

8.1We will supply service that conforms with this contract as this is our legal duty. Our terms do not infringe on your key legal rights.

9.RESPONSIBILITY FOR LOSS OR DAMAGE

9.1If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen.

9.2You accept that we have an interest in limiting the personal liability of our officers and employees and, having regard to that interest, you acknowledge that we are a limited liability entity; you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the website or this disclaimer (this will not, of course, limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees).

9.3We are not liable for business losses. We only supply the products and services for domestic and private use. If you use the services or any products that we supply in providing the services for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

9.4We shall have no liability for any failure by you or any beneficiaries to retain copies of your User Data.

9.5We shall ensure that we have in place appropriate technical measures and safeguards in order to protect the confidentiality of your End User Data and we shall comply with all applicable laws in the provision of the Services. However, we cannot guarantee that our security measures are 100% effective. The Services are provided on an "as is" basis. In particular we do not warrant that the Services (i) will be uninterrupted, error free or available at a particular time or location; (ii) free from viruses or other harmful components; or that (iii) the Services will meet your requirements or expectations. To the fullest extent allowable by law all warranties express or implied relating to the services are excluded.

9.6Our aggregate liability to you in connection with the Services shall not exceed the total amount paid and payable to us for the Services.

9.7We do not exclude or limit in any way our liability to you where it would be unlawful to do so, but the financial and non financial liability is limited to £100 Sterling. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation;or for breach of your legal rights in relation to the Services.

9.8We are not liable for any failure to input correct information or keep information up to date. Your beneficiary will be provided access to account on confirmation of death, we are not responsible for any inability to access the information given the details are functional.
